Custody and Child Support

If parents cannot reach a custody and parenting time (visitation) agreement, the court will make the decision. When determining the custody of a child, a judge considers what is in the best interest of the child. In Michigan, there are 12 factors to consider:

  1. Love and affection between parent and child
  2. Ability of each parent to give the child love and guidance as they continue their education and religious instruction
  3. Ability of each parent to provide food, clothing and medical care
  4. Length of time the child has lived in a stable environment and whether that environment may continue
  5. Permanence of the family unit in each home
  6. Moral fitness of each party
  7. Mental and physical health of each party
  8. Home, school and community record of the child
  9. Reasonable preference of the child, usually if age 12 or older
  10. Willingness and ability of each parent to facilitate a good relationship with the other parent
  11. Domestic violence
  12. Other factors the court considers relevant

Child support in Michigan is based on many factors. Usually, the parent with physical custody pays less child support. The number of overnight visits the child spends with the noncustodial parent will also be considered.
