Determining Property Division and Alimony
Michigan is a no-fault divorce state, which means that you do not have to provide specific proof of your reasons for wanting to divorce. Marital property (assets and debt) is subject to equitable distribution. This means that the property should be divided fairly, not necessarily 50-50. The court will determine property division based on the factors of your divorce.
Marital assets may include personal property, real estate, financial assets, insurance, retirement accounts and stocks. You must also divide debts, such as mortgages and loans, credit cards, taxes and judgments.
Spousal support (alimony) is not based on a statutory formula. Instead, the court will consider a number of factors which may include: the earning capacities of both people, the length of the marriage, each person's level of education, work history, any domestic violence and other issues.
Attorney Dennis Strong will argue for the divorce terms you want and will represent you at trial if a settlement cannot be reached. We can also assist you with child custody and support as well as out-of-state custody matters.
